In exchange for participation in the activity of DudeChat organized by, DudeChat and/or use of the property, facilities, and services of DudeChat, I, agree for myself and (if applicable) for the members of my family, to the following:
1. Agreement to Follow Directions. I agree to observe and obey all posted rules and warnings, and further agree to follow any oral instructions given by DudeChat, or the employees, representatives, or agents of DudeChat.
2. Assumption of the Risks and Release. I recognize that there are certain inherent risks associated with the above-described activity and I assume full responsibility for personal injury to myself and (if applicable) my family members, and I further release and discharge DudeChat for injury, loss, or damage arising out of my or my family’s use of or presence upon the facilities of DudeChat, whether caused by the fault of myself, my family, DudeChat, or other third parties.
3. Indemnification. I agree to indemnify and defend DudeChat against all claims, causes of action, damages, judgements, costs, or expenses, including attorney fees and other litigation costs, which may in any way arise from my or my family’s use of or presence upon the facilities of DudeChat.
4. Costs. I agree to pay for all damages to the facilities of DudeChat caused by any intentional negligent, reckless, or willful actions by me or my family.
5. Enforceability. The invalidity or unenforceability of any provision of this agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of this agreement or of any other applications of such provision, as the case may be. Such invalid or unenforceable provision shall be deemed not to be a part of this agreement.
All services delivered by Dude Chat utilize principles, methods and tools of the DudeChat program and are meant to challenge, uplift and support you psychologically. However, DudeChat is not psychotherapy. If you feel psychologically stressed to the
point that it is interfering with your ability to function, please have the courage to seek the help you need in the form of a professional psychotherapist. DudeChat augments your therapy, but the work of DudeChat is to be done when major emotional and psychological wounds are already healing or healed. In that spirit, please read the following, and sign below should you agree to each statement and wish to proceed:
I understand that the DudeChat services I will be receiving from DudeChat are not offered as a substitute for mental health care. I also understand that DudeChat, is not acting as a psychotherapist and does not purport to offer mental health care.I understand that DudeChat will maintain the confidentiality of our communications only to the extent defined by the laws of the states in which each of us resides.I understand and agree that I am fully responsible for my well-being during my DudeChat sessions and, subsequently, including my choices and decisions.
I understand that all comments and ideas offered by DudeChat are solely for the purpose of aiding me in achieving my defined goals. I have the ability to give my informed consent, and, hereby give such consent to DudeChat to assist me in achieving such goals.
I hereby release, waive, acquit and forever discharge DudeChat and their agents, successors, assigns, personal representatives, executors, heirs and employees (collectively DudeChat") from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of actions, omissions or commissions taken by myself or by DudeChat as a result of the advice given by DudeChat or otherwise resulting from the DudeChat relationship contemplated hereunder.
